    Default Disappointment within minutes!

    Literally having just collected the phone from the store I went to my car and opened the box, and just to my luck the phone is used and damaged!

    So, all these years of steering clear of Carphone Warehouse now make absolutley perfect sense.

    The second they have another in stock it's mine!

    Oh man that Sucks. Still the waiting is half the fun. (Who am I trying to convince)
    Its a bit like Xmas, once the day is actually here all the fun seems to be over in a flash

    Wow that sucks! But they are obligated to give you another one so you should hopefully be ok. And yes for most devices once you get it, it seems that the buzz goes - but as the proud owner today of the Xperia I can say that my excitement is still there - after two weeks? Who knows!

    They told me I can't cancel the contract within 14 days which I'm sure they can't legally do. I have a knack for losing my temper and I'm going to do that with the manager.

    As for the phone, Windows Mobile is a big let-down for this phone. I find it freezes when you click on links, it's complicated to complete even the simplest tasks, both browsers on the phone are awful and the optical joystick is pathetic as it doesn't work most of the time! This is just to name a few!

    However, I do like the silver. I was expecting a similar shade to the T610, which I had and loved, but I'm glad to see it seems to be a darker shade of silver, vaught in the light it almost looks like a champagne silver!

    This phone would be perfect if it wasn't cursed with Windows!

    @scbond, the 14 law only applies to distance selling. The X1 is best to buy on O2 as Orange do not allow cancellation of the contract - as i also found out! I checked with Trading Standards and this situation is correct for purchases from shops. You can exchange items if the phone has a minor defect.

    This must have been a recent change then as I know for sure that you always had the right to cancel within 14 days. If they don't cancel it I just won't pay them and if they touch my credit file then Experian will sort it for me as they always have done!

    Well, it seems even more complicated now. On the CPW site T&Cs, the 14 day period only applies if you haven't used the SIM card!

    I have found that some online sellers have a full 14 day guarantee, and some don't. Not sure about the legal side of all this.

    I must admit the only problem i have now after a months of heavy use is that fact it does stop going to the today screen every 3 or 4 days, bummer, but looking on the bright side it doesnt freeze as it still runs the start buttons and all that and it has been known to people and me on a few times to recovers on its own without a restart. however when it does happen i just restart it... the other let down is i soo soo miss the TrackID (free) that was on my k550i

    the last phone i went out my way to get was the T610 and it was a dream, but even then i missed the previous phone the T28i

    but putting the small bug and the TrackID aside i am still loving this phone Xperia X1.

    and regards to simple, you can make it simple by using a panel that you like sbpshell is a simple one

    So it was an upgrade then, not a brand new contract?
    And losing your temper won't achieve anything, save to motivate the manager not to give a ****. So your 'knack' is essentially useless.

    There is, as I say, a 14-day period on new O2 contracts but there are no cancellations on upgrades.

    Firstly, it's not Carphone Warehouse you're paying, it's O2. If you stop paying, then it'll be O2 screwing your credit history up.
    And Experian are not some cure-all for credit problems. They will only clear things from your record if they are errors, if you just chose to default on your obligations, they won't do a thing.

    Distance selling laws state that you can only return a product if it's unused.
    Since the product in this case is the combined package of phone and SIM card, once you put the SIM in the phone and use it, the product as a whole has been used - however if the phone has been powered on without a SIM and no calls etc have been made, it is still classed as unused.
